While John McCain was explaining on “The View” he wants justices on the SCOTUS who interpret the Constitution and not make law from the bench, Whoopi Goldberg asked if she should be worried about being a slave.
C’mon! Every amendment to the Constitution is still a part of the Constitution and this was a stupid question, in my opinion. Others may differ with me and think it was not a stupid question.

Her question was in response to McCain saying he wants “people (judges) who interpret the Constitution of the United States in the way the founding fathers envisioned for them to do.” Now… I’m not sure if you knew this, but… the founding fathers certainly did not envision the 13th amendment. So I think her point is a fair one, which was, sometimes the Constitution has to change.
The only reason her question was a stupid one is because it wasn’t simple enough for the masses to understand. A lot of people will think she was actually asking if McCain wants black people to be slaves. Which, of course, is not her actual concern. She’s using slavery, which is universally recognized as unjust, to point out that the founding fathers didn’t have all the answers and didn’t get everything right.

I agree with you that he said he wanted law interpreted by the Constitution the founders wrote, but we all know the amendments added to that Constitution are law and cannot be reversed very easily and certainly slavery would not be reversed. We fought a war over slavery. She knew what he meant even as you know what he said, but I think he meant the Constitution as it is and not as it was originally written. Maybe he should have clarified it and maybe he did, but the clip doesn’t show that.
